Terms of subscription

This is a translation provided for convenience. The French version prevails.

1. Purpose

NEXUS (“the Provider”) makes available to the Customer, as a hosted service, the Hypervisible service (“the Service”): periodic readings of a brand’s presence in the answers of artificial intelligence engines, and delivery of the answers, mentions, sources and quantified summaries.

2. Subscription and trial

2.1 The trial lasts 14 days from the creation of the account, without any means of payment. It gives access to the “Trial” plan: one project, twenty-five questions, five engines, two on-demand readings. The weekly reading is reserved for paid plans.

2.2 Subscription to a paid plan is made online (Stripe). The first month is billed upon subscription, then every month on the anniversary date.

2.3 Prices are stated excluding taxes, in euros. VAT according to the applicable regime (to be confirmed).

3. Content of the Service

3.1 The scope (number of projects, questions, engines, competitors, on-demand readings and users) is that of the subscribed plan, as displayed upon subscription.

3.2 For paid plans, the weekly reading is launched every Monday. A reading is said to be complete when at least 90% of the expected answers have been obtained; a partial reading is displayed as such.

3.3 The engines’ answers are obtained from a third-party data provider (DataForSEO). The Provider guarantees neither the permanent availability of each engine nor the stability of the models queried, which are the responsibility of their publishers. An unavailable engine is reported and the reading continues on the others.

3.4 The data needed for the readings is included in the subscription price, within the limits of the plan’s scope.

3.5 The Service measures; it does not guarantee any visibility result.

4. On-demand readings

The number of on-demand readings per calendar month is that of the subscribed plan. Once that number is reached, no further on-demand reading is launched until the following month, and no extra charge is billed.

5. Term, termination

5.1 The subscription is monthly and tacitly renewed.

5.2 The Customer may terminate at any time from their account; termination takes effect at the end of the current month, with no refund for the month already begun.

5.3 After termination, the account remains accessible in read-only mode for 12 months, then the data is deleted. Retention period (to be confirmed).

5.4 The Provider may suspend the Service in the event of non-payment, after a reminder that has remained without effect for 8 days.

6. Data

6.1 The Customer’s data (questions, brands, competitors, answers, summaries) belongs to the Customer. The Provider does not resell it and does not aggregate it into a public offering.

6.2 Hosting: Cloudflare (Workers and D1), with European Union regions preferred. Personal data processed: users’ email addresses, connection log. Processors: Cloudflare (hosting), DataForSEO (obtaining the answers), Stripe (payment), Resend (emails). Legal basis: performance of the contract. Rights: by email to contact@nexus-geo.fr.

6.3 The Customer shall not use the Service to build a competing product or to extract the answers obtained on a massive scale.

7. Availability and support

Application availability target: 99% per month, excluding announced maintenance. Support by email, with a response within two business days; guidance sessions depending on the plan.

8. Liability

The Provider’s liability is limited to the sums paid by the Customer for the last three months. The Provider is not liable for decisions made by the Customer on the basis of the readings.

9. Changes and prices

The Provider may change the Service and its prices; any increase is notified 30 days in advance and entitles the Customer to terminate at no cost.

10. Governing law

French law. The courts having jurisdiction are those of the Provider’s registered office, after an attempt at amicable settlement.
